The Justice Files - May 2017 Published July 12, 2017 By Fairchild AFB Legal Office FAIRCHILD AIR FORCE BASE, Wash. -- During the month of May 2017, six Airmen received nonjudicial punishment under Article 15, Uniform Code of Military Justice, three Airmen were involuntarily separated, and three Airmen were administratively demoted. Commanders used the following actions as means of punishment, rehabilitation and maintaining good order and discipline.NONJUDICIAL PUNISHMENT (ARTICLE 15)92nd Aircraft Maintenance SquadronAn Airman received an Article 15 for failure to go to a scheduled Fitness Assessment appointment, in violation of Article 86, UCMJ. This member’s punishment consisted of a suspended reduction to the rank of Airman Basic, forfeiture of $399.00 pay and a reprimand. 92nd Logistics Readiness SquadronAn airman first class received an Article 15 for failure to go to a scheduled Pre-Separation Counseling appointment, in violation of Article 86, UCMJ. This member’s punishment consisted of a suspended reduction to the rank of Airman and a reprimand. 92nd Maintenance SquadronAn airman first class received an Article 15 for dereliction of duty. Specifically, this member damaged a government owned vehicle when he failed to use a spotter and then he subsequently failed to report the damage. Both incidents were in violation of Article 92, UCMJ. This member’s punishment consisted of a suspended reduction to the rank of Airman, five days extra duty and a reprimand. A staff sergeant received an Article 15 for dereliction of duty. Specifically, damage to a government owned vehicle was not properly reported because this member failed to complete a vehicle inspection properly, in violation of Article 92, UCMJ. This member’s punishment consisted of a suspended reduction to the rank of senior airman, forfeiture of $320.00 pay, fire days extra duty and a reprimand. An airman first class received an Article 15 for dereliction of duty. Specifically, this member lost a government-issued half-face respirator, and then failed to follow lost item or tool procedures, in violation or Article 92, UCMJ. This member’s punishment consisted of a forfeiture of $1,062.00 pay, 15 days extra duty and a reprimand. 92nd Operations Support SquadronAn airman first class received an Article 15 for failing to go to work on time and for making false official statements. Specifically, this member made a false official statement explaining why he was late to work, in violation of Articles 86 and 107, UCMJ. This member’s punishment consisted of a reduction to the rank of airman basic and restriction to the limits of Fairchild Air Force Base for 60 days. INVOLUNTARY SEPARATION ACTIONS92nd Aircraft Maintenance SquadronA senior airman was separated for misconduct: commission of a serious offense. Throughout the months of July, August and September 2016, this airman was involved in a pawn store scam. Specifically, this airman was buying merchandise from one pawn store, reporting the purchases to his credit card company as fraud, and then selling the items for cash to another pawn store. Ultimately, store security discovered his scheme and he was brought up on charges in Spokane. As a matter of policy, the Air Force prohibits UCMJ action on members when civilian authorities retain jurisdiction over the offenses. This policy, however, does not prohibit commanders from taking administrative action. Accordingly, the base separation authority, 92nd Air Refueling Wing commander, approved 92nd AMXS commander’s discharge recommendation and directed this airman’s involuntary separation with an Under Honorable Conditions discharge. Additionally, as a result of this discharge characterization and being a first-term airman, all his G.I. Bill benefits were forfeited.92nd Logistics Readiness SquadronAn Airman was separated for misconduct: drug abuse. Between the months of September 2016 and January 2017, this airman admitted to abusing over-the-counter medication in order to alter his mood or function in violation of Article 92, UCMJ. As a result of his actions, this Airman was punished under Article 15, UCMJ and subsequently recommended for discharge by 92nd LRS commander. The separation authority, 92nd ARW commander, directed his separation with a General discharge. Furthermore, as a result of this discharge characterization, all G.I. Bill benefits were forfeited.92nd Security Forces SquadronAn airman basic was separated for misconduct: minor disciplinary infractions. This Airman was punished under Article 15, UCMJ, for malingering, making two false statements, failing to obey an order and disrespecting an NCO. Prior to this Article 15 action, he was counseled and issued numerous reprimands for similarly related conduct. The separation authority, 92nd ARW commander, approved 92nd SFS commander’s discharge recommendation and directed this member’s separation with a General discharge. Furthermore, as a result of his discharge characterization in conjunction with being a first-term Airman, all of his G.I. Bill education benefits were forfeited.DEMOTION ACTIONS 92nd Aircraft Maintenance SquadronAn airman first class was demoted to the rank of Airman for his failure to meet Air Force physical fitness standards. During his current enlistment, this Airman failed three fitness tests since July 2016. Prior to demotion action, unit rehabilitative measures were taken in the form of diet and exercise education, organized fitness activities, and formal counseling by his unit leadership on the importance of meeting fitness standards. However, these efforts proved unsuccessful, and he was demoted to the rank of Airman.92nd Maintenance SquadronA senior airman was demoted to the rank of airman first class for his failure to meet Air Force physical fitness standards.
