The Justice Files - December 2016 Published Jan. 23, 2017 By Fairchild Air Force Base Legal Office Fairchild Air Force Base Legal Office FAIRCHILD AIR FORCE BASE, Wash. -- During December 2016, two Fairchild Airmen were convicted by Special Court-Martial, five Airmen received nonjudicial punishment under Article 15, Uniform Code of Military Justice and five Airmen were involuntarily separated. Commanders used the following actions as means of punishment, rehabilitation and maintaining good order and discipline.SPECIAL COURT-MARTIAL:92nd Maintenance SquadronAn airman first class was convicted by a special court-martial for one charge and one specification of wrongful use of a controlled substance, in violation of Article 112a, UCMJ. Specifically, this member admitted to wrongfully using alprazolam, also known as Xanax. This member’s punishment consisted of a reduction to the grade of airman basic, forfeiture of $1,044.00 pay per month for five months, hard labor without confinement for 60 days and a reprimand. An Airman was convicted by a special court-martial for one charge and three specifications of wrongful use and distribution of controlled substances, in violation of Article 112a, UCMJ, and one charge and one specification of fraudulent enlistment, in violation of Article 83, UCMJ. Specifically, this member admitted to wrongfully using cocaine and alprazolam, also known as Xanax. This member also admitted to wrongfully distributing Xanax. In addition, this member admitted to deliberately concealing prior unlawful use of cocaine when enlisting in the United States Air Force. His punishment consisted of a reduction to the grade of airman basic, confinement for 100 days, a bad conduct discharge and a reprimand. NONJUDICIAL PUNISHMENT (ARTICLE 15):92nd Force Support SquadronA senior airman received an Article 15 for physically assaulting their spouse, in violation of Article 128, UCMJ. This member’s punishment consisted of a suspended reduction to the grade of airman first class.92nd Aircraft Maintenance SquadronA senior airman received an Article 15 for committing adultery, in violation of Article 134, UCMJ, and wrongfully possessing one pill of alprazolam, also known as Xanax, in violation of Article 112a, UCMJ. This member’s punishment consisted of a reduction to the grade of airman first class with a suspended reduction to Airman, 45 days extra duty and a reprimand. 92nd Communications SquadronA staff sergeant received an Article 15 for dereliction of duty, in violation of Article 92, UCMJ. Specifically, this member willfully failed to complete a required certification which caused the member to lose privileged access to systems that were critical in performing their duties. This member’s punishment consisted of a suspended reduction to the grade of senior airman, 15 days extra duty and a reprimand. 92nd Operations Support SquadronA staff sergeant received an Article 15 for dereliction of duty, in violation of Article 92, UCMJ. Specifically, this member engaged in an unprofessional relationship with a subordinate Airman in the member’s workplace. This member’s punishment consisted of a reduction to the grade of senior airman and a reprimand. 92nd Security Forces SquadronAn airman first class received an Article 15 for dereliction of duty, in violation of Article 92, UCMJ. Specifically, this member was discovered sleeping on duty while posted as an entry controller. This member’s punishment consisted of a reduction to the grade of airman basic with reduction below the grade of Airman suspended, forfeiture of $102.00 pay, 15 days of extra duty, suspended and a reprimand. INVOLUNTARY SEPARATION ACTIONS:92nd Comptroller SquadronAn Airman was separated for misconduct: drug abuse. This Airman was discovered to have wrongfully used 3, 4-methylenedioxy-methamphetamine, also known as MDMA or commonly reffered to as ecstasy. In response to this misconduct, 92nd CPTS commander imposed punishment under Article 15, UCMJ, for wrongful use of an illicit substance and subsequently recommended his involuntary separation. As the base discharge authority, 92nd Air Refueling Wing commander directed this member’s separation with an Under Honorable Conditions (General) discharge. Further, as a result of this discharge characterization, all G.I. Bill education benefits were forfeited.92nd Maintenance SquadronAn Airman was separated for misconduct: minor disciplinary infractions and unsatisfactory performance: failure to meet minimum fitness standards. Over the course of 15 months, this Airman received three letters of reprimand and an Article 15 for various disciplinary infractions. Moreover, this Airman failed four fitness assessments in a 24-month period. As such, the separation authority, 92nd ARW commander, directed this member’s separation with a General discharge for misconduct. Furthermore, as a result of this discharge characterization, all G.I. Bill benefits were forfeited.An airman first class was separated for misconduct: drug abuse. This Airman was discovered to have wrongfully used Hydrocodone. In response to this misconduct, 92nd MXS commander imposed punishment under Article 15, UCMJ, for wrongful use of a Schedule II controlled substance and subsequently recommended his involuntary separation. As the base discharge authority, 92nd ARW commander directed this member’s separation with a General discharge. Furthermore, as a result of this discharge characterization, all G.I. Bill education benefits were forfeited.An airman basic was separated for misconduct: drug abuse. In November 2016, this Airman was convicted by a summary court-martial for wrongfully using alprazolam, also known as Xanax. Upon his release from confinement, 92nd MXS commander initiated involuntary separation action. The separation authority, 92nd ARW commander, directed his separation with a General discharge. Moreover, as a result of this discharge characterization, all G.I. Bill benefits were forfeited.92nd Logistics Readiness SquadronAn Airman was separated for misconduct: a pattern of misconduct, conduct prejudicial to good order and discipline. Specifically, in 2015, this Airman received a letter of reprimand for sexually harassing unit Airmen. Approximately a year later, he received an Article 15 for sexual harassment. Accordingly, the separation authority, 92nd ARW commander, directed this member’s separation with a General discharge. Furthermore, as a result of this discharge characterization, all G.I. Bill benefits were forfeited.
