The Justice Files- Nonjudicial Punishment

FAIRCHILD AIR FORCE BASE, Wash. -- During the month of December 2015, two Fairchild Airmen received nonjudicial punishment under Article 15, Uniform Code of Military Justice, and four Airmen were involuntarily discharged. Commanders used the following as a means of punishment, rehabilitation, and maintaining good order and discipline:

NONJUDICIAL PUNISHMENT (ARTICLES 15) 

A Senior Airman from the 92nd Maintenance Squadron received an Article 15 for failure to go, in violation of Article 86, UCMJ. Specifically, the member was scheduled for weekend duty and failed to report. Punishment consisted of a suspended reduction to the rank of Airman 1st Class, forfeiture of pay, extra duty and a reprimand.

A Staff Sgt. from the 92nd Security Forces Squadron received an Article 15 for assault consummated by battery, being drunk and disorderly, and for communicating indecent language, in violation of Article 128, UCMJ, and two violations of Article 134, UCMJ, respectively. Punishment consisted of a reduction to the rank of senior airman, suspended forfeiture of pay, extra duty and a reprimand. 

INVOLUNTARY SEPARATION ACTIONS       

An airman from the 336th Training Support Squadron was separated for misconduct: drug abuse. The formal investigation revealed that the member wrongfully used Oxycodone. Based on this evidence, this Airman received an Article 15, UCMJ, for wrongful use of Oxycodone, in violation of Article 112a, UCMJ. Based on this misconduct, the 336 TRSS commander recommended this Airman be involuntarily separated. The separation authority, 58th Special Operations Wing commander, directed this member's separation with an Under Honorable Conditions (General) discharge. Moreover, as a result of this discharge characterization, all G.I. Bill benefits were forfeited.

An airman from the 92nd Aircraft Maintenance Squadron was separated due to his civilian conviction for vehicular assault in Spokane, Washington. In January 2015, this Airman was arrested for operating his motor vehicle while intoxicated and for traveling in the wrong direction on a major interstate highway. His actions resulted in a head-on collision. Based on the subsequent  civilian conviction, the 92nd AMXS commander recommended this Airman be involuntarily separated. The separation authority, the 92nd ARW commander, directed this member's separation with an Under Honorable Conditions (General) discharge. Additionally, as a result of this discharge characterization, all G.I. Bill benefits were forfeited.

An airman 1st class from the 92nd AMXS was separated for a number of minor disciplinary infractions. Over the course of approximately 10 months, this Airman received an Article 15, UCMJ, for violations of Articles 92 and 86, UCMJ, and a letter of reprimand for conduct detrimental to unit good order and discipline. Based on this misconduct, the 92nd AMXS commander recommended this Airman be involuntarily separated. The separation authority, the 92nd ARW commander, directed this member's separation with an Under Honorable Conditions (General) discharge. As a result of this discharge characterization, his G.I. Bill benefits were forfeited. 

A technical sergeant. from the 92nd Logistics Readiness Squadron was separated for failure to meet the terms of his alcohol abuse treatment plan due to inability. Due to this NCO's propensity to abuse alcohol and unwillingness to cooperate with treatment, his unit commander recommended his involuntary separation. Furthermore, due to this NCO's alcohol-related misconduct during discharge processing, the separation authority, the 92nd ARW commander, directed this member's separation with an Under Honorable Conditions (General) discharge.
