Justice Files: Nonjudicial punishment for January Published Feb. 11, 2010 FAIRCHILD AIR FORCE BASE, Wash. -- During the month of January 2010, four Air Force members assigned to Fairchild received Nonjudicial Punishment for criminal offenses under Article 15, Uniform Code of Military Justice (UCMJ). Nonjudicial Punishment actions (otherwise known as Article 15s) are administrative actions used by commanders for both punishment and rehabilitation. An airman first class from the 92nd Communications Squadron received an Article 15 for two specifications of failure to go and one specification of making a false official statement, violations of Articles 86 and 107 of the UCMJ, respectively. Punishment consisted of reduction to airman (suspended) and forfeiture of $784 pay for one month. A senior airman from the 22nd Training Squadron received an Article 15 for one specification of provoking speech or gesture, three specifications of simple assault, one specification of disorderly conduct, and one specification of indecent language, violations of Articles 117, 128, and 134 of the UCMJ, respectively. Punishment consisted of reduction to airman first class (reduction to airman suspended), forfeiture of $250 pay per month for two months (suspended), 30 days extra duty, and a reprimand. A senior airman from the 92nd Medical Support Squadron received an Article 15 for one specification of fleeing the scene of an accident, a violation of Article 134 of the UCMJ. Punishment consisted of reduction to airman first class (suspended). A lieutenant colonel from the 92nd Aeromedical Dental Squadron received an Article 15 for three specifications of dereliction of duty (government travel card abuse and failure to pay the government travel card bill in a timely manner), violations of Article 92 of the UCMJ. Punishment consisted of forfeitures of $3746 pay per month for two months and a reprimand. COURTS-MARTIAL During the month of January 2010, two Air Force members assigned to Fairchild were court-martialed for criminal offenses under the UCMJ. A member can be tried by a general, special or summary court-martial under the UCMJ. On Jan. 21 a senior airman assigned to the 92nd Maintenance Squadron was acquitted by a military judge at a special court-martial of one specification of assault by pointing an unloaded firearm at another person. On Jan. 29 an airman first class assigned to the 92nd Logistics Readiness Squadron was found guilty by a panel of officer members at a special court-martial of stealing 20 pills of Hydrocodone from another airman but was found not guilty of wrongfully distributing the Hydrocodone to others. Punishment consisted of reduction to the grade of airman basic, forfeiture of $964 pay per month for three months, confinement for 45 days, and hard labor without confinement for 45 days.
